New Pathways to Permanent Residence for Caregivers Announced

IRCC has announced positive changes to its immigration programs for caregivers.

Two new pilot programs will be announced shortly. One of the main changes is that a caregiver’s eligibility for permanent residence will be assessed before the work permit is issued. After two years in Canada on a work permit, the caregiver will have a direct path to permanent residence.

This is an improvement over the existing programs whereby certain caregivers arrived in Canada in good faith only to later discover that they did not qualify under any existing permanent residence category. These five-year pilots will replace the Caring for Children and Caring for People with High Medical Needs programs. To remedy this, IRCC has announced an Interim Pathway for Caregivers program, open from March 4, 2019 to June 4, 2019, to allow these caregivers to apply for permanent residence.

Other positive changes include issuing occupation-specific work permits (instead of employer-specific work permits) so caregivers can change employers more easily and facilitating family reunification by allowing spouses and common-law partners of caregivers to obtain an open work permit.

Good News for International Students and their Employers: Changes to the Post-Graduation Work Permit Program

IRCC has announced changes to the highly-popular Post-Graduation Work Permit (PGWP) Program. It is an important program for employers who rely on hiring recent graduates from Canadian colleges and universities.

Effective February 14, 2019, students now have 180 days from the date they have been notified by their learning institution that they have met the requirements to complete their program of study to apply for a PGWP (up from 90 days). Additionally, students are no longer required to hold a valid study permit on the day they apply for a PGWP.

IRCC also expanded the PGWP processing instructions to address various situations that could impact a student’s eligibility for a PGWP, such as breaks in study, learning institutions that lose Designated Learning Institution status, strikes, and travel outside Canada before a decision is made on the application.

Other important points to keep in mind are:

  • The PGWP is an open work permit meaning the holder can work for any employer
  • The PGWP applicant may work full-time before receiving a decision on the PGWP application under certain circumstances
  • The duration of the PGWP may be valid from eight months to three years, depending on the length of the study program completed
  • The PGWP cannot be renewed nor does it provide a clear path towards permanent residence, and therefore a long-term immigration strategy may be required

Attention Oscar Nominees, Past Winners & All Others in the Arts and Entertainment Fields!
Canada is known as a popular destination for filmmakers and performing artists. Canada’s immigration law permits many entertainers and those working in the entertainment industry to work in Canada without a work permit or obtain a work permit relatively easily by exempting them from obtaining a Labour Market Impact Assessment (LMIA). Maybe you have been to Canada before or perhaps you have an upcoming project! If so, check out our Canadian immigration primer!

 

Exemption from Work Permit
In some situations, a foreign national may work without a work permit. Those relevant to the entertainment industry are:
  • Film producers employed by foreign companies for commercial shoots; and essential personnel (e.g., actors, directors, technicians) entering Canada for short durations (typically no longer than two weeks) for a foreign -financed commercial (i.e., advertising) shoot (for television, magazines or other media).
  • Performing artists appearing alone or in a group in an artistic performance – other than a performance that is primarily for a film production or a television or radio broadcast – or as a member of the staff of such a performing artist or group who is integral to the artistic performance, if (i) they are part of a foreign production or group, or are a guest artist in a Canadian production or group, performing a time-limited engagement, and (ii) they are not in an employment relationship with the organization or business in Canada that is contracting for their services.
  • Judges, referees or similar officials participating in an international cultural or artistic event.
There is also a short-term work permit exemption allowing for entry for 15 calendar days once every six months or 30 calendar days once every 12 months. This is available to those working in highly-skilled occupations. For example, producers, directors, choreographers and film editors will qualify.

 

Work Permit Options
  • Significant Benefit for TV and film productions – targets foreign nationals in the television and film industry whose position or occupation is essential to a TV or film production.
  • Significant Benefit – General Guidelines – applies to any foreign national whose employment in Canada would create significant social, cultural or economic benefit.
  • Reciprocal Employment – Performing Arts – targets key creative personnel and talent associated with Canadian, non-profit performing arts companies and organizations in the orchestral music, opera, live theatre and dance disciplines.
  • Reciprocal Employment – General Guidelines – permits foreign nationals to obtain a work permit if similar reciprocal opportunities abroad exist for Canadians and if the foreign national’s employment would result in a neutral labour market impact. For example, a Canadian performing arts organization that has a cultural exchange program with a foreign performing arts organization may be able to use this exemption code if it can show that Canadian members are currently participating in the exchange program abroad.
For individuals who do not fit into any of the above categories, a work permit based on a Labour Market Impact Assessment is required. Typically, this entails four weeks of advertising to attract Canadians; however, there are certain situations in which the employer would be exempt from the advertising requirement.

Administrative duties will include but are not limited to:

  • Maintaining the reception desk and reception area
  • Greeting clients and taking coats, offering beverages
  • Answering main phone line, transferring calls, taking messages
  • Monitoring incoming facsimiles and the general in box, and forwarding same
  • Signing for incoming courier packages
  • Requesting courier pick-up

2. duiNew DUI laws in effect in Canada on December 18, 2018 – The immigration implications

Canada’s Criminal Code is changing on December 18, 2018 with respect to driving under the influence of alcohol/drugs. The maximum sentence for alcohol- and/or drug-impaired driving will increase from 5 years to 10 years of imprisonment. This will cause this offence to be considered “serious criminality” instead of “criminality” under Canada’s immigration law.

Foreign nationals and permanent residents convicted of impaired driving in or outside Canada on or after December 18 will be inadmissible to Canada and ineligible for deemed rehabilitation (this means they must apply for a temporary resident permit or individual rehabilitation to enter Canada). Permanent residents may lose their permanent resident status.

It remains unclear what the implications will be for persons convicted of a DUI prior to December 18, 2018.

The National Immigration Law Section of the Canadian Bar Association has asked the Minister of Immigration to consider how the change in maximum sentence will affect foreign nationals and permanent residents in and outside Canada. No changes to immigration policy tempering the impact of the December 18 change have been announced as of yet. Future issues of the Corporate Immigration Law Firm Newsletter will provide up dates as they become available.

3. biomPhase two of biometrics for entry to Canada rolls out on December 31, 2018

Since July 31, 2018, citizens of countries in Europe, the Middle East and Africa have been providing biometrics in order to enter Canada. On December 31, 2018, citizens of countries in Asia, Asia Pacific and the Americas will also be required to provide biometrics in order to enter Canada. The only exception to this is for American citizens. Otherwise, all travellers who are visiting, studying, working or immigrating to Canada will provide fingerprints and a photo. For individuals who are visa-exempt, biometrics will be provided upon arrival at the port of entry in Canada. For those who require visas, biometric collection points are located around the world.

4. tppComprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) in effect December 31, 2018; Trans-Pacific Partnership Immigration Provisions

The CPTPP is a new free trade agreement between Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore and Vietnam, making it one of the largest free trade agreements in the world. The provisions pertaining to Temporary Entry for Business Persons include categories that cover: Business Visitors, Short Term Business Visitors, Service Sales Persons, Intra-Corporate Transferees, Investors, Independent Executives, and Persons Responsible for Setting up a Commercial Presence, Professionals and Technicians.

Among the noteworthy provisions, is the introduction of an Intra-Corporate Transferee category for management trainees on professional development. In additional, the categories of Professionals and Technicians that qualify vary depending on the country.

The new agreement is of benefit to those seeking temporary entry to Canada from the signatory countries as it opens up other options beyond those currently available.

5. parentsParent and Grandparent Pool to open January 2018

For the 2019 season, Immigration, Refugees and Citizenship Canada (IRCC) has made changes to the Parents/Grandparents sponsorship selection process. Instead of the ‘lottery’ based system employed in the previous three years, this coming year IRCC will select applicants on a first-come first-served basis. It is expected that on January 2, 2018, IRCC’s dedicated parents/grandparents expression of interest webpage will be live where sponsors can complete an Expression of Interest (EOI) in order to be considered for selection. If sponsors submit more than one EOI, the government will select that the most recent EOI. If selected, sponsors will be invited to submit a complete application. Future issues of the Corporate Immigration Law Firm Newsletter will provide an updates with respect to the number of applications selected.

6. iecInternational Experience Category Work Permits – Pool Now Open

On December 4, 2018, International Experience Canada (IEC), IRCC’s program allowing foreign youth to come to Canada for the purpose of working and travelling, started accepting applications from applicants from 34 different countries worldwide for the 2019 season. Depending on the applicant’s country of origin the program provides the applicant with up to three different categories to qualify under: Working Holiday, Young Professionals and International Co-op Internship.

The 2019 season provides even more applicants between the ages of 18 and 30 (or 35 depending on the applicant’s country of citizenship) with the opportunity to submit their application.

Other changes include opening the program to citizens of Portugal, increasing the participation age of Australian citizens and clarifying that Danish citizens residing in Greenland or the Faroe Islands continue to be eligible.

Late during the 2018 season IRCC had expanded the program selection available to Austrian citizens to include the Working Holiday category and the frequency of participations for citizens of Chile had been increased to two (2) participations.

7. travelTravel plans for the holidays? Make sure you are prepared

Have plans to go away over the holidays or this winter. Always be sure to check your documents (well, in advance of leave for the airport!!). Make sure that passports and/or PR cardsfor everyone that will travel with you are valid. This applies to Nexus, too. For those who are on work permits or visas, ensure those are valid too. If you will be travelling alone with a child, be sure to have travel authorization letters from the other parent or parents of the child.

8. electronicElectronic devices and border Crossing

Exercise caution when taking electronic devices across borders. Canada Border Services Agency (CBSA) officers routinely search the electronic devices of individuals entering Canada, both randomly and in a targeted fashion. The courts have not taken a clear position regarding what border officers can and cannot do when searching or seizing an electronic device. Travellers who have refused to provide their passwords have been threatened with arrest and with hindering or obstructing a CBSA officer.

Here are some best practices to keep in mind. The best safeguard against an electronic search is to not carry the data at all when crossing the border. Consider dedicating a device for travel purposes and do not store any sensitive data on it. Remember that deleted data on an electronic device, while not easily accessible by an officer, can likely be retrieved with the use of recovery software. Keep in mind that data stored in the cloud, once accessed by a device, may be stored on the device and accessible without an internet connection. Separate privileged and confidential documents and label them accordingly, and inform the officer conducting the search that you are in possession of sensitive documents.
